ANALISIS KOMPARATIF MASLAHAH DAN MAFSADAH DALAM TRANSAKSI JUAL BELI URBUN ANTARA MAZHAB FIQIH
Abstract
Urbun buying and selling transactions are one of the economic practices that attract attention in the study of Islamic fiqh. Urbun is a concept where the buyer pays part of the price of the goods to the seller as a guarantee of his seriousness in making the purchase. This study aims to analyze urbun buying and selling transactions from the perspective of maslahah (interest) and mafsadah (loss) in the Islamic jurisprudence school of thought. This research methodology involves a comparative analysis between the views of several leading schools of jurisprudence, including the Shafi'i, Maliki, Hanbali, and Hanafi schools of thought. The study findings show that there are variations in opinion among these schools of thought regarding the legality, maslahah, and mafsadah in urbun buying and selling transactions. Some schools of thought may view urbun as a practice that can provide benefits to the parties involved, while others may view it as potentially causing harm. It is hoped that the results of this analysis will provide a better understanding of the legal and moral implications of urbun buying and selling transactions in the context of justice and social welfare in Islamic societies.
